Marijuana Possession in Colorado: What Are My Rights?

In November 2012, the state of Colorado legalized the recreational use of marijuana. As one of the few states to pass such legislature, residents were thrilled at this newfound freedom. All that to say, marijuana use is not without certain laws. Users are expected to abide by these laws or face penalties for their misbehavior.

The state has the right to regulate the use of marijuana and this applies to possession, distribution, and cultivation. Understanding laws of possession is important, because this is where the majority of marijuana use comes from.

How does the state regulate marijuana possession?

Colorado residents 21 and older are allowed to possess one ounce of marijuana or less – doing so will not incur any penalties. Additionally, of age residents can transfer one ounce or less if they are doing so without any intent to receive payment.

Going over the one ounce limit is where penalties begin to kick in. Offenders can face the following punishment if they violate Colorado's marijuana laws:

  • Up to two ounces: a petty offense punishable by a $100 maximum fine
  • Public uses of less than two ounces: a petty offense punishable by up to 15 days incarceration and a $100 maximum fine
  • Two to six ounces: a misdemeanor punishable by up to one year incarceration and a $1,000 maximum fine
  • Six to 12 ounces: a misdemeanor punishable by up to 18 months incarceration and a $10,000 maximum fine
  • More than 12 ounces: a felony punishable by up to 18 months incarceration and a $100,000 maximum fine

So while Colorado residents do have freedom when it comes to marijuana use, it is important to remember that laws are still in effect. Violating these laws can have a lasting impact on your personal life and the freedom that you've come to expect.
