Understanding the State's Cultivation Laws

It is a crime in Colorado to cultivate or produce more than six marijuana plants for personal use at one time. Additionally, it is also a crime to knowingly allow plants to be grown on your own property. The penalties can be severe and are based on the number of plants being cultivated.

Some of the most common penalties are detailed below:

  • Six plants or fewer: Cultivating six plants or fewer for anything other than personal use is a misdemeanor and punishable by up to 18 months in jail and/or up to $5000 in fines.
  • Between seven and 29 plants: Considered a class five felony, offenders can face up to three years in prison and/or up to $100,000 in fines.
  • 30 or more plants: A class four felony that is punishable by up to six years in prison and/or up to $500,000 in fines.
